U.S. President Donald Trump's former personal lawyer Michael Cohen exits his hotel in New York City

"Inconceivable that the government would break into a lawyer's office (early in the morning) - nearly unheard of", Trump tweeted Saturday morning.

The recording, which hasn't been made public, was discovered as part of an Federal Bureau of Investigation raid in April on attorney Michael Cohen's home office and hotel in NY, sources told ABC News.

NY state, for example, has a "one-party consent" law, which makes it a crime to record an in-person or telephone conversation unless one party participating in the conversation consents.

Trump and Cohen discussed the possible payment after AMI bought the rights to McDougal's story for $150,000 in August 2016.

But in a further twist to the story, Giuliani tells NBC reporter Kelly O'Donnell on Saturday that the president has waived attorney-client privilege related to the tape.

Cohen, who became Trump's personal lawyer in 2007, is infamous for paying $130,000 to Daniels - real name, Stephanie Clifford - shortly before the 2016 election to keep quiet about her alleged affair with Trump. An attorney for Cohen called Trump's statement "false". But suffice it to say that when the recording is heard, it will not hurt Mr. Cohen. But her opinion changed this year when she learned new details about the deal, including that her lawyerh at the time and AMI had both been in contact with Cohen while her deal was being negotiated.

"We have no knowledge of any of this", she said.
