What's that extra in my online cart? Soon, maybe a sales tax

Jenny Kane Associated Press

Today's ruling on South Dakota vs. Wayfair, Baker told reporters, helps level the playing field with the brick-and-mortar retailers. The decision was seen as a victory for brick-and-mortar stores, which felt they were at a disadvantage to online outlets that did not need to collect the taxes.

Officials say that a U.S. Supreme Court ruling that retailers must collect sales tax from buyers in other states could mean more than $200 million a year to IL.

The Supreme Court ruling in a 2016 South Dakota case overturns a 1992 decision, Quill Corp. v. Here in IN, former Gov. Mitch Daniels' administration agreed not to seek the sales taxes in exchange for Amazon locating several warehouses in the state.

The decision could lead to individual state sales tax laws, or Congress could step in to make more uniform regulations.

Shares in online retailers like Amazon.com (amzn), Wayfair (w), Etsy, (etsy) Overstock.com (ostk) and eBay (ebay) all fell in the wake of the decision.

The Supreme Court on Thursday ruled that states can collect sales tax from all retailers, even if those retailers do not have a "physical presence" in their state - ultimately paving the way for states to collect sales tax from online retailers. So far, more than 250 companies have registered to collect sales taxes on MA consumers as a result, although the rule remains subject to a court challenge by Crutchfield, an out-of-state electronics retailer.

Saudi Arabia's Salem Al-Dawsari scores his team's second goal against Egypt during their World Cup match on June 25, 2018. Egypt finished bottom of Group A and failed to pick up a point, losing against Uruguay, Russia and Saudi Arabia .

Chief Justice John Roberts offered the dissenting opinion, along with Justices Stephen Breyer, Elena Kagan, and Sonia Sotomayor. The issue has also been an irritant to state governments, deprived of billions of dollars a year at a time many are struggling to balance budgets.

Justice Clarence Thomas, who ruled in favor of striking out the 1992 law, said that a "quarter century of experience has convinced me" the Supreme Court's earlier decision was no longer justified, adding that it was "never too late" to arrive at a better position. It will leave shoppers with lighter wallets but is a big financial win for states.

Today's ruling says states can only collect on taxes from online retailers that sell more than $100,000 of goods in the state. Online sellers that haven't been charging sales tax on goods shipped to every state range from jewelry website Blue Nile to pet products site Chewy.com to clothing retailer L.L. Bean.

But e-commerce trade group Netchoice called the ruling a "blow to consumers and small online businesses", according to a statement emailed to Retail Dive.

While Amazon and other large online retailers regularly collect sales taxes on purchases, many others have refused to do so. That means the case will be sent back to South Dakota for a final decision.
