US prosecutors charge former VW chief Winterkorn

The U.S. Justice Department on Thursday disclosed the filing of criminal charges against former Volkswagen AG Chief Executive Martin Winterkorn, accusing him of conspiring to cover up the German automaker's diesel emissions cheating.

Winterkorn, who resigned in November 2015 in response to the scandal, said he was not aware of any wrongdoing at the time of his resignation.

In the grand jury indictment, unsealed Thursday in Federal District Court in Detroit, Winterkorn was charged with four counts of violating US federal law.

Two former engineers have pleaded guilty.

The indictment alleges that by the summer of 2015, U.S. regulators threatened to withhold authorization for VW to sell Model Year 2016 diesel vehicles in the United States until VW answered their questions about the discrepancies uncovered by the ICCT study.

Volkswagen has been fighting to move past the emissions scandal, vowing to spend billions on a number of new electric vehicles as it has seen USA sales rebound.

Mr Winterkorn has been accused of conspiring to mislead regulators about the fraudulent emissions testing, defrauding USA customers, and wire fraud, making him the ninth person to be hit with U.S. criminal charges connected to the "Dieselgate" scandal.

In July 2015, when the U.S. threatened not to re-certify Volkswagen diesels because their emissions numbers were so off, Winterkorn asked his employees for a briefing on the situation.

The objective of the wire fraud reportedly committed by Winterkorn and others was "to unlawfully enrich VW and themselves". About 11 million Volkswagen vehicles, including half a million in America, were secretly and deliberately equipped with "defeat devices" that allowed them to cheat diesel emissions tests.

The U.S. Environmental Protection Agency accused VW of using a so-called "defeat device" on its 2.0-liter turbodiesel. "The indictment unsealed today alleges that Volkswagen's scheme to cheat its legal requirements went all the way to the top of the company". One Italian citizen, former Audi manager Giovanni Pamio, is in Germany awaiting extradition. The prosecution alleges that Winterkorn may have known of the cheats as early as 2014. The indictment was issued in March and unsealed Thursday, May 3.

When the USA began looking into the discrepancies found between the declared and discovered emissions levels, Winterkorn made a decision to hide the "defeat device in responding to questions from United States regulators, while appearing to cooperate, " Ars Technica reports.

Winterkorn had served as VW's CEO and management board chairman from January 2007 until September 2015.
