18 States Sue Trump Administration Over Census Citizenship Question

It would be the first time in 70 years that the government used the census form sent to every household to ask people to specify whether they are US citizens.

The citizenship question has become the latest explosive dividing line in immigration and race under President Trump, with the full array of anti-Trump organizations lining up to oppose the 2020 census decision. Yet demanding citizenship information in the census is expected to depress participation among immigrants, causing a population undercount that would disproportionately harm states and cities with large immigrant communities.

The states suing are New York, Connecticut, Delaware, Illinois, Iowa, Maryland, Massachusetts, Minnesota, New Jersey, New Mexico, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia and Washington.

In announcing the lawsuit Tuesday in New York City, Schneiderman called the citizenship question unsafe and damaging.

The Constitution says the count is used to apportion congressional districts between the states, but in reality the information is used for much more, including drawing the district lines for Congress and state legislatures, and for doling out hundreds of billions of dollars in federal cash assistance foe education, infrastructure and other needs. "In return, they rightfully expect to receive our state's fair share of federal funding for our roads and schools and an appropriate number of representatives in Congress".

Yet as Schneiderman and 18 other states argued in a letter sent to the Commerce Secretary in February, the demand would have precisely the opposite effect by driving down participation in immigrant communities - a concern that is even more acute in today's political climate.

In the lawsuit, filed in the U.S. District Court for the Southern District of NY, the states argue that the decision to ask about citizenship status will not properly carry out the Constitution's Enumeration Clause, which states that the "actual enumeration" of people in the United States be used to determine congressional districts.

The NAACP has said the plans for the census will lead to a massive undercounting of blacks.

The attorneys general argue that adding an untested citizenship question to the Census is therefore unnecessary as well as damaging to accuracy because of its impact on response rates.
