Former Supreme Court Justice John Paul Stevens Pens Passionate Plea to Repeal Second Amendment

Throwing weight behind the students and protesters who joined the "March For Our Lives" rallies demanding a control on gun violence on Saturday, March 24, retired justice of the US Supreme Court John Paul Stevens felt the demonstrators should also seek the Second Amendment of the country's constitution repealed. Inspired by student survivors of the February 14 Parkland massacre, an estimated 200,000 protesters gathered in Washington, D.C., on Saturday to push for gun control.

The overwhelming majority of amendments have not passed, and only one has been repealed.

A mass shooting last month at the Marjory Stoneman Douglas High School in Parkland left 17 people dead and is the catalyst for the "March for Our Lives" movement.

Some scholars noted that Stevens' op-ed could be counterproductive to legislative efforts to regulate guns, which would have broader public support than repealing the Second Amendment.

"The blame is getting passed on to gun owners and there are hundreds of lawful gun owners in the United States who do not do anything illegal", Thomas said. He had previously called for changing the Second Amendment to permit gun control. (No substantive constitutional amendments have gone into effect since 1971, when a nation in the midst of the Vietnam War lowered the voting age from 21 to 18.) The Second Amendment, as written, is a negative right.

That was the latest volley from the 97-year-old Stevens who 10 years ago dissented from the landmark ruling that the Second Amendment protects an individual right to keep and bear arms for self-defense.

In his op-ed column Mr. Steven sharply criticized the Heller decision, which he wrote "has provided the N.R.A. with a propaganda weapon of huge power".

In a separate tweet, Kasky said "responsible ownership of a small weapon" isn't something he opposes.

Stevens made the potentially inflammatory call to repeal the amendment, which describes "the right of the people to keep and bear arms", in a New York Times editorial.

The organization's aims are spelled out clearly on its website: Its teenage constituents want increased funding for gun violence research, looser restrictions at the Bureau of Alcohol, Tobacco, Firearms and Explosives, universal background checks, a ban on high-capacity magazines and a comprehensive ban on assault weapons.

The retired justice is somewhat of an expert on the second amendment, having considered its proper scope in the 2008 case District of Columbia v. Heller. The amendment then has to be approved by three-quarters of the states. Stevens retired from the court in 2010, after more than 35 years.

Presidents have no power to amend the Constitution, which makes it kind of amusing when presidential candidates propose constitutional amendments as part of their platforms.

But now gun rights advocates are saying "go ahead, make my day" to Stevens's latest call.

Set aside, for the moment, the fact that amendments to the Constitution require ratification by the legislatures of at least three-quarters of the 50 states, many of which boast storied traditions of conservative-leaning governance and would never dream of signing off on this.

In a Wednesday morning tweet President Donald Trump vowed to protect the Second Amendment.
