The bench of Justice Arun Mishra has been under much controversy.

According to the sources, all five top judges of the Apex Court concluded that the institution was capable of resolving all issues by itself and the public intervention was not invited.

After meeting Chelameswar in the afternoon, Mishra said, "We have been told that there is no crisis".

A resolution, and some administrative changes in the Supreme Court that addresses the grievances of the four judges, are imminent, said a person familiar with the matter who asked not to be identified. The judges are trying to resolve the issue among themselves after Justice Kurian Joseph on Saturday ruled out possibility of mediation by any outsider. "This must be done immediately to restore public confidence in the judiciary and in the Supreme Court".

The Bar Council of India even set up a seven-member delegation and met Justice Misra and 14 other judges on Sunday. The case has been deferred as one of the judges on the bench, Justice M M Shantanagoudar, will not attend the court on Monday. The 5-judge bench will hear major cases such as those challenging the constitutional validity of the Aadhaar Act and its 2013 judgement re-criminalising gay sex between consenting adults. Only such measures would assure the people that the Supreme Court is functioning in a fair and transparent manner and that the power of the Chief Justice as master of roster is not being misused to achieve a particular result in important and sensitive cases.

Venugopal, the attorney general, also hoped that things will be sorted out in the next few days.

He also said the death of special CBI judge B H Loya, who was trying the Sohrabudin Sheikh fake encounter case, should not be raked up as his family members have made their stand clear and want no more harassment.

Dave had apparently tried to persuade Poonawalla by alleging that Justice Mishra was a "henchmen" of CJI Dipak Misra and hence the bench headed by Justice Arun Mishra was should not hear the case.

Meanwhile, the Supreme Court on Tuesday adjourned hearing in the crucial and contentious Judge Loya case for a week, and told the Maharashtra government to share all the documents, including the medical report of Judge Loya, with the petitioners-journalist Bandhuraj Sambhaji and political activist Tehseen Poonawala.

In that first of it's kind press conference, the four judges had said that there is an immediate need to protect the judicial system in the country in order to protect democracy.
