Drawing for tied House race delayed; Democrats to file challenge

A dramatic race for a seat in Virginia's House of Delegates took another turn Tuesday as the Virginia State Board of Elections postponed a lot draw to determine victor of a House of Delegates race. That decision left the two candidates tied with 11,608 votes each in a district that encompasses the shipping hub of Newport News in southeastern Virginia, setting the stage for the equivalent of a coin toss to pick a final victor.

In a letter to the State Board of Elections, Simonds' lawyers said they have filed a petition with the recount-panel, and are waiting for them to rule on their motion for suspension and motion for reconsideration of the ambiguous ballot.

A recount appeared to declare candidate Shelly Simonds victorious over Republican Del.

Election officials in Newport News, Va., examined ballots that a computer failed to scan.

"At the end of the day, this is really about the integrity of elections in Virginia", Simonds said during a conference call with reporters.

The Virginia House Republican Caucus told Reuters in a statement that it was reviewing the court filings. The official had let the vote remain uncounted before raising concerns the next day.

The ballot shows the voter filled in the bubble for both Yancey and Simonds, but there was a line through the bubble for Simonds.

Simonds is running againt Republican Del.

Simonds's campaign has also requested the drawing be delayed so it can convince the court that the vote shouldn't be counted. Initially Yancey won by ten votes. But Heal said Yancey stands by the arguments made last week by his attorneys. A lawsuit is pending over the results of a hotly contested race in the 28th District in the Fredericksburg area. But voters filed a lawsuit in federal court after at least 147 ballots were found to be assigned to the wrong districts.
