Star Citizen developer denies all charges in multi-pronged Crytek legal assault

Crytek says its agreement with Cloud Imperium for the CryEngine only covered Star Citizen, not Squadron 42, which it reportedly considers a separate game. The game license agreement signed between Crytek and the Star Citizen developers allegedly required the exclusive use of CryEngine for the game's development, and also for the developers to prominently display Crytek's trademarks and copyright notices in Star Citizen and marketing material created around the game. You can head over to DSOG and read the list of complaints against the companies, but what is odd is that those games no longer use the Crytek engine, but Crytek is arguing that it is being rebuffed after considerable investments for the project.

Crytek points out a comment made by Chris Roberts back in September 16, 2016, where he said, "we don't call [the video game engine] CryEngine anymore, we call it Star Engine".

We are aware of the complaint having been filed in the US District Court.

Cloud Imperium Games has dismissed - in a statement on Polygon - the claims as "meritless" and said it will "defend vigorously" against them, but they may prove hard to wash away. There are three equally entertaining outcomes to the investment: the single-player Squadron 42 and its much more ambitious counterpart will either one day release, and be an absolute revelation of PC gaming supremacy; it will be at best the most mediocre, and therefore, terrible, game ever made; or it will never, ever see the light of day as a complete product. Now, Crytek is of the opinion that Squadron 42 is not included in their initial agreement and that Cloud Imperium Games agreed to exclusively develop Star Citizen with CryEngine.

If Crytek were to win, there's no telling how much of a sum that could net them, but it could deal quite a financial blow to Star Citizen.

As if Star Citizen doesn't have enough troubles. Crytek further alleges that RSI did not provide promised CryEngine bug fixes mentioned in the contract and shared confidential pieces of CryEngine code in a "BugSmashers" video series.

In a statement, CIG and RSI called the lawsuit "meritless".

Crytek says it charged "a below-market license rate" for Star Citizen to use its engine.

Crytek is now seeking a minimum of $75,000 indirect damages, indirect damages, consequential damages (including lost profits), special damages, costs, fees, and expenses incurred by the breach of contract and copyright infringement.
