Net Neutrality vote must wait until conclusion of comment investigation, Schneiderman says

"The integrity of the public record matters". "In fact, there is good reason to believe that the record may be replete with fake or fraudulent comments, suggesting that your proposal is fundamentally flawed".

The FCC is scheduled to hold a vote on December 14th over an order to replace and repeal the 2015 rules enforcing net neutrality.

"Without additional information about the alleged anomalies surrounding the public record, the FCC can not conduct a thorough and fair evaluation of the public's views on this topic, and should not move forward with a vote", Hassan and 27 other senators - including Sens. Last week, internet users took to Reddit's front page to highlight their senator's support-or lack of support-for net neutrality and detail how much money their representatives have taken from the telecom lobby.

Schneiderman and FCC Commissioner Jessica Rosenworcel urged the agency's chair, Ajit Pai, to fully cooperate with the state's investigation of more than one million comments that were made nationwide during the public discussion. Pai, who was appointed by Trump to lead the FCC, has argued that "these heavy-handed regulations" restrict internet service providers and make it harder for providers to build out their networks, he said in a statement last month.

The FCC's commenting system is not like an election.

Schneiderman says his office requested the actual comments records from the FCC numerous times but so far the FCC has not complied. An updated analysis by the Attorney General's office found that approximately one million of these comments may have misused the real names and addresses of Americans - including tens of thousands of New Yorkers. For decades, it has served as the medium by which many people around the globe have connected and learned from each other and in its wake, technology has expanded dozens of times over to facilitate these connections via email, instant messaging and now video calling.

A separate study from the Pew Research Center indicated that among the record public comments about net neutrality filed with the FCC over a four-month period, only 6% were unique comments. By Monday, Schneiderman said, they had received more than 3,000 responses - including, he said, from a man who said his deceased mother's name had been used. Eshoo has worked for years on net neutrality.

Meanwhile, an FCC member called on the commission to delay a scheduled December 14 vote on repealing net neutrality rules enacted under the Obama administration until an investigation can be completed.

"We are hoping they can delay the vote so we can get to the bottom of this", he said in a news conference.

Spurred by HBO's John Oliver, who rallied his viewers to support existing regulations, a tsunami of comments flooded the FCC website during the open comment period, hitting almost 22 million. According to the sources, Chairman Pai's staff had expressed concern that any attempt to block fraudulent comments would result in accusations that Pai was trying to censor net neutrality advocates. "None", Schneiderman said in the letter to Pai.
