Cuomo bans vaping e-cigs indoors in public places

The bill in question (S.2543A/A.516A) bans all e-cigarette and vape use "everywhere that smoking tobacco products are prohibited". That means e-cigarettes are now banned in any place in which smoking tobacco products are banned.

Gov. Andrew Cuomo has signed a bill into law putting the curtailment on new and old nicotine conveyance systems.

In New York, around 70 percent of the state's municipalities already have bans on the books, according to the American Lung Association. NY state is the 11th to ban public vaping at the state level.

"This new law not only protects public health by restricting the use of e-cigarettes and the public's exposure to smoke-cigarette emissions", said Jeff Seyler, the executive vice president of American Lung Association's Northeast region, but also children, for whom the products are "just another tool reeling them into a risky and often lifetime of addiction to nicotine".

But the New York State Health Department warned that vaping carries its own risks because the aerosol emissions can include formaldehyde, cadmium found in batteries, benzene found in gasoline and the industrial solvent toluene.

The New York State Court of Appeals rejected the most recent challenge to New York City's ban earlier this year, finding the inclusion of e-cigs in the law was valid. Though the action ultimately failed, C.L.A.S.H. claimed that the regulation of e-cigarettes as an addendum to the Smoke-Free Air Act was unconstitutional. In July, the governor banned vaping on school grounds. Vaping is the act of inhaling vapor produced by a vaporizer or e-cigarette. "E-cigarettes often contain toxic chemicals in addition to nicotine, something bystanders should not be forced to breathe", Hannon said in a state news release.

Singh, who indicated that he believes the new law is unnecessary, said the products he sells may be a health risk but are the lesser of two evils.
