Ezekiel Elliott Eligible to Play Again ... But Suspension Still Looms

That's because a Texas judge is waiting to lift the injunction that was allowing Elliott to play, sources tell CBS Sports Radio Legal Analyst Amy Dash.

As we reported. a federal appeals court threw out a lower court's ruling Thursday that was allowing Zeke to play this season, so his suspension became effective again immediately.

The NFL players' union has issued notice that it will request an en banc hearing - a hearing of the full panel of judges with the 5th U.S. Circuit Court of Appeals in New Orleans - on behalf of Cowboys running back Ezekiel Elliott. This rendered Elliott's ban effective immediately, preventing him from taking the field when the Cowboys next suit up on October 22.

In a 2-1 decision on Thursday, the court ruled the initial injunction filed by the NFLPA was premature because at the time it was filed, Elliott's appeal to the National Football League had not been decided.

By rule, Elliott and the NFLPA have 14 days to file a petition for a rehearing. If Elliott's legal team can't put the suspension on hold again, he won't be eligible to play until November 30 at home against Washington, a Thursday night game the week after Thanksgiving. Elliott has rushed for 393 yards in the Cowboys' five games, averaging just 3.7 yards per carry. Had the petition been filed during the season, Brady would've had to serve his suspension, which means if the 5th Circuit takes more than about a week to decide, Elliott will have to remain on the sideline until it does. As of now, Elliott is set to be suspended through Week 12. Elliott was never charged and has continued to deny any wrongdoing.
