UK Islamic school guilty of sex discrimination for segregating boys and girls

Friday's Court of Appeal ruling, which will affect other mixed-sex schools that have a segregation policy, said: "The High Court was wrong to approach the question of whether there had been less favourable treatment by reason of sex by looking at each sex as a group".

The Muslim Council of Britain criticised the ruling, saying there were other faith schools around the United Kingdom that separated boys and girls but were not facing similar action.

According to the Daily Mail, Helen Mountfield QC, representing the watchdog, had said segregating pupils in a mixed sex school was against the Equality Act 2010.

For religious reasons the voluntary-aided school, which has about 770 pupils aged between four and 16, believes total separation of the sexes from age nine onwards is obligatory.

The Ofsted boss argued that single-sex schools were justified as they helped girls overcome the discrimination they still faced in modern Britain.

During the appeal hearing, the school's lawyer said boys and girls at the school were "treated entirely equally while segregated".

Drawing comparisons to single sex schools, the Muslim Council of Britain joined Birmingham City Council in accusing Ofsted of holding the city's Al-Hijrah school "to a different standard to other faith schools around the country".

They said Ofsted had main it clear that they would apply a "consistent approach to all similarly organised schools".
