In its report entitled "Mirage at Dusk", the KNCHR said that the dead included a six 6-month-old baby, who was clobbered by armed security agents whilst under the care of its mother in Kisumu County in western Kenya.

"Other deaths were attributed to police using live bullets and a few from police bludgeoning using clubs", said part of the report read out to the Media by KNCHR chairwoman Kagwiria Mbogori. But Odinga, who leads the National Super Alliance (NASA), says not enough has been done to address the problems.

Odinga who reportedly jets out of the country on Tuesday is set to hold a series of high-profile engagements, including giving a lecture at the Royal Institute of International Affairs commonly known as Chatham House.

However, the President and his team will likely insist that the IEBC should proceed and declare that President Uhuru Kenyatta be declared re-elected unopposed under Article 138 (1), which states that if only one candidate is nominated, then such a candidate shall be declared elected.

Odinga and his party not only withdrew from the race but they are demanding new elections by pointing to a 2013 Supreme Court decision that calls for the Independent Electoral and Boundaries Commission to cancel upcoming elections if a major presidential candidate dies or "abandons the electoral quest before the scheduled dates". Kenya's President Uhuru Kenyatta has appealed to the opposition to hold legal demonstrations, not street protests, and allow Kenyans to get back to normal life after last week's disputed vote.

It was not immediately clear whether the election will go ahead or whether Kenyatta will automatically be declared president.

"There is a lot of uncertainty, with people asking if there will be disruptions in elections in the strongholds of Odinga", she said.

"We are filling the Jubilee box".

"We are sure we will get more votes than the last time", Kenyatta told a rally in the southern town of Voi, speaking in Kiswahili.

The IEBC would then go ahead and hold the election by printing the ballots with the Nasa candidate therein and supervise voting on October 26 and thereafter declare a victor. Odinga has threatened to boycott the fresh elections if the electoral commission is not reformed.

Odinga also wants independent global experts to be engaged to manage the entire ICT framework of the elections, with close supervision of the candidates' agents and the IEBC.

"Kenya is a democratic country and there is no court that can force me to participate in an election I know will be rigged".

Kenyans are due to head to the polls again on October 26 to elect their president.

He vowed that until their demands are met, there will be demonstrations every Monday and Friday, and they will not be ready for the October 26 election re-run.

The opposition had said the elections had been fraught with irregularities despite electoral observers calling it free and fair.
