'Making a Murderer' defendant Steven Avery denied new trial

Steven Avery, the focus of hit Netflix true-crime series Making A Murderer, has been denied a request for a new trial.

As ABC News reports, Sheboygan County, Wisconsin, Judge Angela Sutkiewicz issued the ruling Tuesday.

An attorney for Steven Avery said she intends to file an amended appeal after a judge denied his request for a new trial.

Avery is now serving a life sentence with no chance of parole for the 2005 rape and murder of Teresa Halbach.

"The basis for the order to vacate will be that an agreement was reached between Mr. Avery's attorneys and the Wisconsin Attorney General on September 18, 2017, to conduct further testing and to allow Mr. Avery to amend his petition with new scientific test results and additional witness affidavits", Zellner said in the statement.

Making a Murderer investigated Ms Halbach's death - casting doubt on the legal process used in the investigation and subsequent court cases. "With the addition of these new scientific test results and new evidence, Mr. Avery's attorneys remain confident that his conviction will be vacated".

The documentary series calls into question the investigation and trial that put Avery and his nephew, Brendan Dassey, behind bars, and alleges the investigators and police in the case planted evidence and otherwise manipulated the outcome of the trial.

"The scientific testing is not completed".

Dassey had confessed to detectives he helped his uncle rape and kill Halbach at the Avery family's salvage yard.

The false testimony aspect of the case has already proved to hold some merit in the courts, as a judge overturned Dassey's conviction earlier this year. A judge overturned Dassey's conviction last year, ruling that investigators took advantage of the then-16-year-old Dassey's cognitive disabilities and tricked him into confessing. He remains in custody.
