Dallas Cowboys' Ezekiel Elliott's Case To Be Heard In Federal Court

- The injunction could be vacated based upon the merits of the NFL's case against Elliott.

Oral arguments for Ezekiel Elliott's hearing in his legal case against the National Football League regarding his six-game suspension took place Monday at the 5th Circuit U.S. Court of Appeals in New Orleans. In his opinion, Mazzant agreed with Elliott's lawyers that the NFL's disciplinary process was fundamentally unfair to Elliott because key information was left out of the final investigative report given to Goodell.

The 22-year-old Elliott was suspended by Goodell in August after the league concluded following a yearlong investigation that he had several physical confrontations last summer with his girlfriend at the time. The league's argument to the 5th Circuit in favor of blocking the preliminary injunction centers on the fact that Elliott filed his lawsuit against the NFL before Harold Henderson, the arbiter appointed by Goodell to hear the appeal, chose to uphold the suspension.

Judge Graves, meanwhile, questioned the NFL on whether exhaustion was needed before filing the suit, while the league was also pushed on the issue of irreparable harm, with judges noting that it may have undermined its own argument in that case with its actions prior to Week 1.

Despite his best effort, there was no way Elliott was getting that first down, but he gave Dallas a great chance to get there when they had no other options.

If the appeals court on Monday sides with the league, then Elliott's suspension could go into effect as early as this week.

The court could deny the stay, which likely means Elliott would be able to play for the full season, and the legal battle to play out for the 2018 season.

Also at issue was whether the National Football League would be "irreparably harmed" by a court-imposed delay in its disciplinary decision, or whether it would be Elliott who would suffer irreparable harm if forced to immediately serve the suspension.

Until the court decides that District Court Judge Amos Mazzant had the right to hear Elliott's appeal or whether to dismiss lawsuit altogether, the running back will be eligible to play.

At the close of the hearing, Prado said that the panel would get back to Elliott and the league "as soon as possible". The Cowboys will host the Green Bay Packers next Sunday, the last game before their bye week.
